DMCA POLICY

Digital Millennium Copyright Act — Notice and Takedown Procedures

1. Overview

Yourflix respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our service that are reported to our designated copyright agent.

This policy outlines our procedures for handling DMCA takedown notices, counter-notifications, and repeat infringer policies.

2. Reporting Copyright Infringement

If you believe that content available through our service infringes on your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following information:

  • Identification of the copyrighted work that you claim has been infringed, or if multiple works are covered, a representative list of such works.
  • Identification of the material that you claim is infringing and that you want removed or access to which you want disabled, with enough detail so that we may locate the material.
  • Your contact information, including your full legal name, mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Your physical or electronic signature.

3. Designated DMCA Agent

We aim to respond to all valid DMCA notices within 48 business hours of receipt.

4. Counter-Notification

If you believe that material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which the service provider may be found.
  • A statement that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action within 10 business days, we may restore the removed material.

5. Repeat Infringers

In accordance with the DMCA, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

6. Good Faith Requirement

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

7. Modifications to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Your continued use of our service after any changes constitutes your acceptance of the new policy.
